It’s The Predatory Perversion, Stupid

Another Massachusetts judge with a soft spot for dangerous criminals.  We’ve got a lot of them. Judges with soft spots and dangerous criminals.  This one … the dangerous Level Three sexual offender … having been freed by a judge, had a ski mask, duct tape and gloves in his rape kit when he followed a woman into the ladies room, blocked the door and stuck his head under her booth, the cops say. He told cops all he wanted was a good look at her.  He ran when she screamed. Theoretically, that makes the judge right, he isn’t sexually dangerous. He’s sexually disturbing and intrusive and had the potential to be sexually dangerous as well as a history of it, but sexually, criminally, chickened out.

I have an idea.  This is a serious problem. As former Bristol County DA Paul Walsh notes of the pervs he attempted to have civilly committed by Judge Richard T. Moses, they just keep doing it. Walsh meant the predators, but it applies to the judges as well. They just keep doing it. Here’s my solution to this troubling problem of reoffending pervs, and the judges who free them.

Lock up the judges. There’s a sound basis in law for it. You drive the getaway car in a bank robbery, embark on a criminal venture in which someone else carries the gun and pulls the trigger, you’re just as guilty, and will do time. Even if you didn’t think anyone was going to get killed. The sexual predator who was busted this week after allegedly stalking a woman inside a Braintree bookstore bathroom was set free by the same judge who sprang another convicted pervert accused of raping a child in a New Bedford library last month.

Superior Court Judge Richard T. Moses refused to lock up David Flavell in February 2006 because he did not think the Level 3 offender was “sexually dangerous.”

Flavell, 38, was arrested Tuesday night for allegedly peeping at a woman in a Braintree Borders bookstore bathroom stall on Jan. 29.

Corey Saunders, who allegedly raped a 6-year-old boy just a few feet from the child’s mother inside a New Bedford library, was also released from custody by Moses in 2006, over the strenuous objections of the district attorney and three psychologists who argued that he posed a serious threat to children.

“It just floors me when something that looks this predictable happens again,” said former Bristol District Attorney Paul Walsh Jr., whose office tried to have both Flavell and Saunders civilly committed.

“People get over their drug habits, people get over their gambling addictions, but I’ve never, ever seen it happen with sexual offenders,” Walsh said yesterday. “The recidivism rate is well-known. The cure rate is zero. We seem to wait until the next horrendous thing happens before there’s a change of approach.”

Flavell, 38, a homeless Level 3 sex offender, has a two-page criminal history that includes two convictions for open and gross lewdness and one for assault with intent to rape. He was being held last night on $10,000 cash bail after pleading not guilty in Quincy District Court to misdemeanor charges stemming from the incident at Borders.

According to Assistant Norfolk District Attorney Danielle Ross, Flavell told police he followed the alleged victim, a 36-year-old Holbrook woman, into the ladies room because he thought she was “attractive” and blocked the entrance with a bookcase. Flavell allegedly claimed he had no intention of raping the woman, but only “wanted to get a look at her butt.”

Flavell fled when the woman screamed, but Ross said that when he was arrested Tuesday at a Brockton doughnut shop, police found gloves, a black ski mask and duct tape inside the same backpack he carried at Borders.

Gregg Miliote, spokesman for Bristol District Attorney Sam Sutter, declined to comment on Flavell’s latest arrest except to say, “This office did move to have him held as a sexually dangerous person. Unfortunately, the judge did not agree.”

Moses declined comment yesterday because of Flavell’s pending case, but a statement released by a court spokeswoman said, “The February 2006 decision . . . was based upon substantial testimony of multiple experts who said that Mr. Flavell was not sexually dangerous.”

Moses also released Saunders in 2006, ignoring three expert psychologists who found the Level 3 offender an “extremely sexually dangerous” predator.

In his Valentine’s Day 2006 order releasing Flavell from the Massachusetts Treatment Center, Moses said, “While the court acknowledges that there is a possibility that Flavell will once again engage in his exhibitionist conduct, the court concludes that it is not likely that he will do so.”

Here’s the mother of Alexandra Zapp, a young woman slashed to death as she fought off a sexual predator in a Massachusetts rest stop Burger King ladies room in 2002. A State Police lieutenant arrived, heard the commotion and fought the predator, but it was too late.  Andrea Casanova is grateful someone else isn’t living her nightmare, but has dedicated her life to pressing authorities to address the problem. A Massachusetts judge had declined to civilly commit Leahy, a repeat violent sexual predator.
