Perv-friendly judge freed another encore rapist. Boston Herald

 

A brain-damaged Level 3 sex offender who allegedly raped a man in Taunton this week was set free last May by the same judge who sprang an accused Braintree bathroom stalker and another predator charged with raping a child in a New Bedford library last month.

Superior Court Judge Richard T. Moses released Kenneth Stone, 37, of Taunton at a May 31 hearing over the objections of prosecutors and two experts who wanted the five-time offender deemed “sexually dangerous” and to remain committed at a Bridgewater treatment facility.

Stone pleaded not guilty in Taunton District Court on Tuesday to a charge he raped a man in his 20s last Sunday at the alleged victim’s grandmother’s Taunton home, said Gregg Miliote, spokesman for Bristol County District Attorney Sam Sutter. Stone is being held without bail.

Moses could not be reached for comment. Superior Court spokeswoman Joan Kenney, noting Moses is prohibited from commenting on a pending case, released a statement saying the judge concluded last May “that the commonwealth did not meet its burden of proving beyond a reasonable doubt that the defendant is sexually dangerous.”

Moses, appointed by former acting Gov. Jane Swift in 2003, is the same judge who in 2006 released notorious predator Corey Saunders, accused of raping a 6-year-old boy inside a New Bedford library last month. At Saunders’ civil commitment hearing, three psychologists had argued he posed a serious threat to children and was sexually dangerous.

In February 2006 Moses set free David Flavell, 38, a Level 3 sex offender who was arrested last week for allegedly peeping at a woman in a Braintree Borders bookstore bathroom stall on Jan. 29.

In the wake of those cases, Middlesex District Attorney Gerry Leone is pushing a bill that would allow only juries to determine whether an offender is sexually dangerous.

“The problem which has been illustrated by the three recent tragic cases shows the need to support Gerry Leone’s legislation,” Miliote said, adding “We are attempting to keep these people off the street.”

    Wow. It is unbelievable that a judge could sleep well at night knowing he released someone accused of such a hideous crime. It is disgusting. What the hell is Judge Moses thinking? Impeach him. He is putting children at risk everywhere.
