		<description>What&#039;s sad is that Bush tried more than once to get the detainees at Gitmo tried, and never got credit for it.  First he wanted to use military tribunals, and the Supreme court shot that down, saying that the executive did not have authority to set up the tribunals.  He then worked with Congress, using the Supreme Court&#039;s findings as a guide, to pass the Military Commissions Act of 2006 (MCA), which authorized and outlined the creation of military commissions to hold trials for these prisoners.  The Supreme Court, ignoring its own recent findings and precedents of long standing, declared that portion of the MCA to be unconstitutional.  

So what&#039;s left?  Trying them in our regular courts?  Treating them like common criminals?  Bad, bad idea, but that&#039;s where we&#039;re headed.  Obama knows it could blow up in his face, which is why he kicked the can down the road for (at least) a year.</description>
