Caution: Girl Texting

WCBS, Staten Island teen falls into an open manhole while texting. She bruised, cut, covered with raw sewage. Sounds terrible. Sounds like a cautionary tale. No, not that it’s stupid not to look where you’re going! It’s not like that girl has a legal obligation not to be a nitwit! 

Those deadbeat DPW hacks should have put up a cone. C’mon, there are drunks and texters wandering around out there. Good thing she wasn’t texting in a crosswalk with an oncoming texting teen driver. That would have been a text-fecta. As long as we’re on the subject, how come it’s still legal to text while driving in 36 states? I tried that once. Almost hit a tree. I just hope the teen driver … or grownup moron … who slams head on into my car while texting on one of the windy roads around here is also speeding, so it’s over quick.

The argument could be made that a ban on texting while driving is more nanny statism, already covered by “reckless driving.” Given that its as dangerous as being drunk and unlike helmet and seatbelt laws, addresses a threat posed to others, I don’t think so. However, I’d be satisfied with an “aggravated moronocy” charge to be added to any personal injury, property damage or motor vehicle homicide charge, adding or upping the time to be served.

You know, a charge like that could be applied more broadly to a lot of things. Never happen, but imagine if you could haul up pols on that one. Think about the possibilities. Yeah, there’s potential for abuse …

    Someone who was texting while driving killed a cyclist near my home town – on a wide, empty, straight piece of road.

    I was amazed the driver got away with a slap on the wrist.
