Wow. If they actually win this case, then it would certainly be a brand new use for the attainder clause. Current precedent only covers confiscation of property and limitation of rights, not federal funding. It also only applies to groups when the group is used as a method to easily identify and punish individual members.
Logically, wouldn’t this imply that any group or individual specifically excluded from funding available to comparable groups or individuals could sue under the attainder clause?

In other words, the lackwit judge who granted the injunction considers Federal money the personal property of ACORN. This should be no surprise considering that nanny-staters think that genuine personal property is prey to whatever demands the Feds make of their subjects.
